General Terms and Business Conditions

1. General Conditions
The following general terms and conditions for all sales of "Sixtone Music" referring all contracts, shipments and other additional services. Aside from the following terms and conditions, all additional arrangements have to be made by written from and must be confirmed in written form by Sixtone Music, to be legal.

"Sixtone Music" has the right to change the general terms and conditions, eventually including all additional arrangements, every time by guaranteeing a reasonable term of notice. All orders placed before the date of change, are delivered to the old conditions.

2. Offer
All offers of "Sixtone Music" are without obligation and small changings and technical differences comparing to our sales descriptions and product pictures are possible. Each offered catalogue loose becomes obsolete by the appearance of the next released edition.

3. Payment and Delivery Conditions
Concrete information regardingg pay- and shipment conditions you`ll find in the order form. There is no minimal order quantity. All our products including the official german tax (20%), as far as no VAT.No. for business accounts or other official business registration informations of oversears business accounts received to Sixtone Music. Sixtone Music reserves the right to send incomplete parcels, as far as a reasonable delivery is guaranteed. All special and additional delivery services for our customers are billed with the general extra costs of the deliverer.

4. Delivery Time
All offered products, stored and available (we can`t be charged for delivery delays in any case) we`ll be able to send within 7 working days. In case of non stored and non available but offered products, we try to deliver as fast as possible. In case of uncontrolable natural, social and economical forces the delivery time expands for a resonable time automatically. For all not in time delivered products because of other than above announced resons, the customers has the right to send a written appointed time of delivery combined with a order cancelation. All not in time delivered parcels caused by producers or cooperation partners of Sixtone Music for over 2 month, entitle the customer and "Sixtone Music" to cancel the contract. There is no compensation possible, caused of delayed or not sent products.

5. Return Rights
We guarantee for all non used and sealed products a return right of 14 days. Returns have to be sent back in time. The date of invoice is the first day of return time. We`re just forced to take returns as long as they are correctly returned and postage paid in full by the customer.

There is no return right for all special offers or special sales acitivity products.

6. Shipping Risk
The risk of shipping is on customer, when the parcel leaves our warehouse "Sixtone Music".



7. Liability
"Sixtone Music" guarantees that the offered and sold products are free of fabricational damages in the moment the order responsibilities went over to the customer. When the parcel received by the customer, he is in charge to check the parcel for obvious damages and has to declare it to the deliverer as a non-acceptable parcel. In every case obvious and hidden damages have to be declared in written form in 10 days to Sixtone Music. Otherwise the customers loose the guarantees for any damages. The guarantees leading six month from the date of invoice. All customer complaints have to be returned to Sixtone Music together with the invoice and free of charge.

The guaranties are not referred to normal wear and tear traces. All guaranties expired in case of any manipulation by the customer.

"Sixtone Music" has generally the right during the period of guarantee the right, for free of charge replacement. Partwise or complete replacements are regular. If replacements are not happened in a reasonable span of time, the customer has the right to lower the product price or get a credit note.

8. Ownership
Until the complete payment for any orders received to "Sixtone Music", the products of the order remain property of Sixtone Music.

9. Data Storage
By Austrian data law (BDSG) we inform you that we only use and store your datas for business in our computer system by following the legal law § 33 (BDSG).

10. Place of Ligitation
Jurisdiction for the customer and "Sixtone Music" will be the district of   Kufstein, Austria. Only austrian law justifies the business between any customer worldwide and Sixtone Music. UN Law is excluded.

11. Return procedure:
In case of serious damage, or any fault caused by Sixtone Music, Sixtone will take care for the return shipping costs. In all other cases, the customer pays the costs for any returns in full. All obviously damaged parcels have to be declared as non-acceptance to the deliverer. In case of a return, the sales contract is canceled automatically and Sixtone Music will send back already arranged payments immediately. To ensure the return right, the parcel has to be sent back in two weeks. Sixtone Music will reply in 2 weeks to all return questions. Sixtone Music   reserved the right, to lower the credited amount for any returned goods, by indicating wear and tear traces. All shrinked or sealed products are non returnable goods, as far as unsealed, unshrinked.

12. Salvatore Clause
Should some regulations of this contract be void or invalid or should become invalid or should there be a gap this should not influence the efficacy of the contract. The void, invalid or incomplete regulation is , if need be, to replace in the way of the contract interpretation resp. contract completion and that in a form which comes up nearest to the economic and legal objective.
